Activity Waiver & Assumption of Risk

READ BEFORE BOOKING ANY ACTIVITY. This document concerns physical risk of serious injury or death. It applies each time you or a minor in your care participates in any wrestling activity discovered, arranged, booked or paid for through WrestlingHub. It forms part of our Terms of Service.

1. What WrestlingHub Does and Does Not Do

WrestlingHub, Inc. is a technology platform. We help families find and book independent coaches, clubs, camps and clinics. We do not provide instruction. We do not operate, host, sponsor, staff, inspect or supervise any practice, lesson, class, clinic, camp, tournament or facility. We do not provide medical care, athletic training, first aid, chaperoning or transportation.

Every coach, trainer, club and camp organizer on the Platform is an independent third party responsible for their own services, personnel, venues, equipment, supervision, safety practices, insurance and legal compliance. Your agreement for any activity is directly with that provider.

2. Nature of the Activity and Risks

Wrestling, grappling and combat-sport training are inherently dangerous, full-contact physical activities. Risks are inherent to the activity, cannot be eliminated by any amount of care, skill, instruction, supervision or protective equipment, and include but are not limited to:

Risks also include the possibility of negligent or inadequate instruction, supervision, screening, matching of participants, facility maintenance, or emergency response by a provider or third party, and the possibility of misconduct by another participant, coach or person present.

3. Assumption of Risk

By participating, or by permitting a minor in your care to participate, you certify that you have read and understand the risks in Section 2, that participation is entirely voluntary, and that you knowingly, freely and expressly assume all such risks, both known and unknown, and accept full responsibility for any resulting injury, illness, disability, death, or loss of or damage to property.

4. Fitness, Medical Clearance and Consent to Treatment

You represent that the participant is physically fit and medically able to take part, has no condition that would make participation unsafe, and has obtained any medical clearance recommended by a physician, including following any prior concussion or injury. You agree to disclose relevant medical conditions, allergies and medications to the provider.

You authorize any provider, facility or event staff to obtain emergency medical treatment for the participant if they judge it necessary, and you accept financial responsibility for that care. You confirm the participant is covered by health insurance, or accept responsibility for all medical costs. WrestlingHub does not provide, arrange or pay for medical care and carries no accident or health coverage for any participant.

5. Provider Waivers Are Separate

Coaches, clubs, camps and facilities generally require their own waivers, medical forms, codes of conduct and registration documents. Those are agreements between you and that provider. WrestlingHub is not a party to them, does not review or approve them, and does not enforce them. Read anything a provider asks you to sign. Nothing in this document limits any rights or obligations you have with a provider, or substitutes for their paperwork.

6. Insurance

Coaches, clubs and camp organizers are required by our Terms to maintain their own commercial general liability insurance and any other coverage appropriate to their activities. WrestlingHub does not verify, guarantee or monitor whether any provider actually holds insurance, or whether any policy is in force, adequate or applicable to a given claim. We recommend you ask any provider for proof of current insurance before booking, and that you confirm your own health and accident coverage.

7. Release and Covenant Not to Sue

To the fullest extent permitted by applicable law, you, on your own behalf and on behalf of your heirs, executors, administrators, personal representatives and assigns, hereby release, waive, discharge and covenant not to sue WrestlingHub, Inc. and its officers, directors, employees, contractors, agents, investors, successors and assigns from and against any and all claims, demands, actions, causes of action, damages, liabilities, losses, costs and expenses of any nature, whether arising in contract, tort, statute or otherwise, and whether for personal injury, illness, disability, death, property damage or economic loss, that arise out of or relate in any way to participation in any activity discovered, arranged, booked or paid for through the WrestlingHub Platform, including any such claim arising from the ordinary negligence of any released party.

This release does not extend to claims that applicable law does not permit to be released, and does not purport to release gross negligence, recklessness, or willful, wanton or intentional misconduct where applicable law prohibits such a release.

This release does not release any coach, club, camp operator, facility, event organizer or other third party. Your rights and remedies against those parties are entirely unaffected.

8. Parents and Legal Guardians

If the participant is under 18, you represent that you are that participant's parent or legal guardian with full authority to sign on their behalf, and you agree to this document both individually and on the minor's behalf, to the fullest extent permitted by applicable law.

Important note on state law. Some states, including New Jersey, limit or refuse to enforce a pre-injury liability release signed by a parent on behalf of a minor child. Where that is the case, the release in Section 7 does not apply to the minor's own claims. In those circumstances, the assumption of risk in Section 3, the indemnification in Section 9, and the limitation of liability in our Terms of Service remain fully effective, and this document remains fully enforceable as to the parent's or guardian's own claims.

9. Indemnification

To the fullest extent permitted by applicable law, you agree to defend, indemnify and hold harmless WrestlingHub, Inc. and the parties listed in Section 7 from and against any claim, demand, action, damage, liability, loss, cost or expense, including reasonable attorneys' fees, brought by you, by the participant, by any family member, or by any third party, arising out of or relating to participation in any activity discovered, arranged, booked or paid for through the Platform.

10. Photography and Media

Providers, facilities, event organizers and other participants may photograph or record activities. WrestlingHub does not control that. If you do not want a participant photographed, raise it with the provider directly. Where you upload images or video to the Platform, you confirm you hold all necessary consents, including written parental consent for any identifiable minor.

11. Safety Reporting

If you have any concern about the conduct of a coach, club or camp, or about the safety of a minor, report it to us at contact@wresthub.com. If a child is in immediate danger, contact local law enforcement first by calling 911. Concerns involving abuse or misconduct in Olympic and Paralympic movement sport may also be reported to the U.S. Center for SafeSport. We may suspend or remove any listing while a concern is reviewed, and we may disclose information to law enforcement or child protective authorities as described in our Privacy Policy.

12. Acknowledgement, Severability and Governing Law

You acknowledge that you have read this entire document, that you understand it is a release of legal rights and an assumption of risk, that you sign or accept it freely and voluntarily without inducement, and that you intend it to be as broad and inclusive as permitted by law.

If any provision is held invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remainder will continue in full force. This document is governed by the laws of the State of New Jersey and is subject to the dispute resolution and arbitration provisions in Section 21 of our Terms of Service.
